Dear Sir:

 

Authorization is requested to enter into an Intergovernmental Agreement (IGA) with the Village of Niles (Village) to construct a bioswale and permeable parking lot, and make payment to the Village in an amount not to exceed $200,000.00.

 

On December 3, 2015, the Board of Commissioners authorized the District to negotiate IGAs with several municipalities, including the Village, to allow the District to contribute funding towards the construction of various green infrastructure projects. The Village will construct a bioswale and permeable pavement parking lot at Oak Park, which is a park centrally located in the Village. The project will reduce localized flooding, reduce the flow of stormwater into the local combined sewer system, and provide educational and volunteer opportunities for the Village. The project will provide an estimated 53,811 gallons of stormwater storage for which the District will seek credit under the Green Infrastructure requirements of the Consent Decree, subject to approval by the United States Environmental Protection Agency.

 

The District’s contribution towards this project will not exceed $200,000.00 with partial payments made to the Village at predefined intervals during construction, which is anticipated to take place entirely in 2016. To date, the Village has spent at least $23,765.00 on engineering, property acquisition, and other design-related project costs. The Village will also contribute approximately $200,000.00 towards the construction cost of this project. The IGA will require the Village to advertise and award the construction contract in conformance with the District’s Purchasing Act, assume responsibility for design, construction, perpetual maintenance and operation of the project, and be solely responsible for any change orders to the project. The IGA will also contain provisions which allow District oversight of the project’s design and construction.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority to enter into an IGA with the Village and make payment to the Village in an amount not to exceed $200,000.00 for construction, operation, and maintenance of a bioswale and permeable parking lot. It is further requested that the Chairman of the Committee on Finance, the Executive Director, and the Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds are available in Account 501-50000-612400.
