Authority is requested by the Chief of Maintenance and Operations for the Board of Commissioners (Board) to declare an emergency to procure services to furnish, deliver and install a 7 MVA transformer at the Calumet TARP Pumping Station.
On December 12, 2007, the transformer for the W-2 pump at the Calumet TARP Pumping Station failed, leaving the W-2 pump out of service. The Engineering Department (Engineering) had previously arranged to have the transformer replaced by Kenny Construction Company (Kenny) as a change order under Contract 04-294-2M at the Board Meeting of November 17, 2005. After the failure, Kenny agreed to immediately replace the transformer under this change order, thus obviating the need to declare an emergency at that time. However, Kenny recently reneged on the terms of this change order.
Immediate replacement of the failed transformer is deemed essential to the protection of public health and the environment.
In accordance with Section 11.5 of the Purchasing Act, it is requested that the Board of Commissioners declare an emergency affecting public health and safety and that the Board of Commissioners authorize the District to enter into an agreement with Divane Bros. Electric Co. to Furnish, Deliver and Install a 7 MVA Transformer at the Calumet TARP Pumping Station, Contract 08-800-01, in an amount not to exceed $500,000.00. Divane Bros. Electric Co. is able to mobilize immediately.
Due to the approximately 12-week lead time to obtain a new transformer, it is requested that the Board fix the date on which the emergency is to terminate as July 31, 2008.
