On October 16, 2014, the Board of Commissioners (Board) granted authority to enter into an Intergovernmental Agreement (IGA) between the District and the Board of Education of the City of Chicago (CPS) to install Green Infrastructure (GI) at various Chicago public schools at a maximum of 30 schools under the Space to Grow program (Program), in an amount not to exceed $3,000,000 per year for five years. Thereafter, on December 3, 2015, the Board amended its authority to enter into an IGA with CPS for an amount not to exceed $15,000,000, at a maximum of $500,000 per school for a maximum of 30 schools, with flexibility as to the number of schools funded in any given year. On July 21, 2016, the District and CPS fully executed the IGA.
A First Amendment to the captioned IGA was authorized by the Board on July 19, 2019, and executed on October 7, 2019, which provided additional funding not to exceed $1,000,000 toward the design of GI improvements at up to 10 of the 30 schools under the Program. Additionally, the First Amendment extended the expiration date of the IGA through December 31, 2022.
Currently, 26 of the schools’ GI installations have been completed and the final four schools under construction in 2022 have reached preliminary acceptance, with some finishing work to be completed in Spring 2023. Accordingly, a Second Amendment is required to extend the IGA through 2023 to allow for the District to complete its reimbursement payments to CPS, with all other terms of the IGA remaining the same. CPS has requested the Program partners consider negotiating a new IGA into the upcoming years, and authority to negotiate this new IGA will be requested of the Board at a subsequent board meeting.
Based on the foregoing, the Engineering Department recommends that the Board authorize the Second Amendment to the IGA wherein the District extends its expiration date through December 31, 2023. It is further requested that the Chairman of the Committee on Finance, Executive Director and Clerk be authorized to execute said amendment to the IGA on behalf of the District, upon approval by the Director of Engineering as to technical matters and by the General Council as to form and legality.
