Dear Sir:
On August 11, 2011, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 10-049-3S North Side Plant Drain Rehabilitation, NSWRP.
In response to a public advertisement of September 14, 2011, a bid opening was held on October 18, 2011. The bid tabulation for this contract is:
KENNY CONSTRUCTION COMPANY $449,200.00
Five hundred ninety-eight (598) companies were notified of this contract being advertised and nine (9) companies requested specifications.
The Director of Procurement and Materials Management has reviewed the bidders’ list for this contract, and is satisfied that the market for this service has been adequately solicited. A planholders’ survey revealed the following reasons for not bidding: do not do sewer lining projects, and were too busy to provide a bid. In light of these findings, the Director of Procurement and Materials Management is of the opinion that the bid received is a fair and reasonable price, and nothing would be gained by rejecting the sole bid and re-advertising this contract.
Kenny Construction Company, the lowest responsible bidder, is proposing to perform the contract in accordance with the specifications. The estimated cost for this contract was $450,000.00, placing the bid of $449,200.00, approximately equal to the estimate.
Kenny Construction Company is in compliance with the Revised Appendix D as indicated on the attached report. The protected class utilization for this contract is 6 percent Minority Business Enterprise (MBE), and the bidder offers MBE credits to satisfy the Small Business Enterprise (SBE) participation.
Kenny Construction Company has executed the Multi-Project Labor Agreement (MPLA) certificate as required. It is anticipated that all construction trades will be utilized on this project, with the exception of: boilermaker, brick mason, construction machinist, elevator constructor, iron worker ornamental, marble setter, and terrazzo worker. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 10-049-3S, to Kenny Construction Company, in an amount not to exceed $449,200.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
