Authority to grant a 35-year, 10’ x 900’ non-exclusive easement to the Village of Hanover Park to continue to construct, reconstruct, operate, maintain, repair, replace and remove a 6-inch water main and sanitary sewer located on the west end of the Hanover Park Water Reclamation Plant premises in Hanover Park, Illinois.  Consideration shall be a nominal fee of $10.00

Dear Sir:

 

On February 16, 2012, the Board of Commissioners granted a 5-year, 10’ x 900’ non-exclusive easement to the Village of Hanover Park (“Hanover Park”) to construct, reconstruct, operate, maintain, repair, replace and remove a 6-inch water main and sanitary sewer located on the west end of the Hanover Park Water Reclamation Plant (“Plant”) premises in Hanover Park, Illinois.  The easement was granted for a nominal fee of $10.00 and expires December 31, 2018.

 

The easement is located within Hanover’s leasehold site, which comprises 44 acres of District real estate located within the Plant premises for public and recreational purposes.  The leasehold comprises a 21-acre area located east of Barrington Road along the western boundary of the Plant (“western parcel”) and a 23-acre area located between Sycamore Avenue and Walnut Avenue along the eastern boundary of the Plant.  The lease commenced January 1, 2013, expires December 31, 2052.

 

Hanover Park has requested a new 35-year easement to continue to operate and maintain the water main and sanitary sewer to coincide with the expiration of the lease.  A 35-year easement is being requested so that its termination can coincide with the lease’s expiration.  The District’s technical departments have reviewed Hanover Park’s request and have no objections thereto.  A nominal fee of $10.00 is recommended as is customary for governmental entities using District property for a public purpose.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it grant a 35-year, 10’ x 900’ non-exclusive easement to the Village of Hanover Park to continue to construct, reconstruct, operate, maintain, repair, replace and remove a 6-inch water main and sanitary sewer located on the west end of the Hanover Park Water Reclamation Plant premises in Hanover Park, Illinois.  Consideration shall be a nominal fee of $10.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute the easement agreement on behalf of the District after it is approved by the Acting General Counsel as to form and legality.
