Dear Sir:

 

Authorization is requested to enter into an Intergovernmental Agreement (IGA) with and make payment to the Forest Preserve District of Cook County (FPDCC) for the construction, operation and maintenance of green infrastructure as part of the permeable pavement parking lot and native plantings project at the Dam #4 East Woods location near Park Ridge, Illinois (18-IGA-08), in an amount not to exceed $319,933.00.

 

On November 2, 2017, the Board of Commissioners authorized the District to negotiate IGAs to assist various local municipalities and other governmental organizations with Green Infrastructure (GI) projects, including the FPDCC. The FPDCC proposes the construction of a permeable pavement parking lot and native plantings located at the Dam #4 East Woods. The Dam #4 East Woods is located near Devon Avenue and Dee Road, between the City of Park Ridge, the Village of Rosemont, and the Edison Park Neighborhood of the City of Chicago. The project is expected to reduce local flooding in the area, and provide educational opportunities for students and visitors on the benefits of GI. The project will provide an estimated 94,212 gallons of stormwater storage for which the District will seek credit under the Green Infrastructure requirements of the District’s Consent Decree, subject to approval by the United States Environmental Protection Agency.

 

The District and the FPDCC have agreed in principle to the terms of the IGA, which include payment by the District towards construction costs of the captioned project in an amount not to exceed $319,933.00. Partial payments to the FPDCC will be made at predefined intervals during construction, which is anticipated to begin in 2018 and be completed in 2019. The FPDCC has contributed to engineering and other design-related costs, and will also contribute towards the total construction cost of $501,903.00 for this project. The IGA will require the FPDCC to advertise and award the construction contract in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement and Affirmative Action Requirements, assume responsibility for design, construction, maintenance and operation of the project, and be solely responsible for any change orders to the project. The IGA will also contain provisions which allow the District oversight of the project’s design, construction and maintenance.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to enter into an IGA with and make payment to the FPDCC in an amount not to exceed $319,933.00 for the construction, operation and maintenance of the project. It is further requested that the Chairman of the Committee on Finance, Acting Executive Director, and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds for the 2018 expenditure, in the amount of $50,000.00, are available in Account 501-50000-612400. The estimated expenditure for 2019 is $269,933.00. Funds for the 2019 expenditure is contingent on the Board of Commissioners’ approval of the District’s budget for that year.
