Authority to settle potential District claim against Edgewood Valley Country Club arising out of damage to Southwest Side Intercepting Sewer 17-C in the Village of LaGrange, Illinois, in the amount of $10,000.00

The District owns and operates a section of intercepting sewer known as Southwest Side Intercepting Sewer 17-C (“Intercepting Sewer”) under and through certain property owned by the Edgewood Valley Country Club (“Edgewood Valley”) in the Village of LaGrange, pursuant to an Easement Agreement.

 

During a sewer inspection conducted by the District earlier this year, the District identified damage to the Intercepting Sewer that requires repairs. It is believed that Edgewood Valley caused the damage, which is estimated to cost $10,000.00 to repair.

 

Edgewood Valley has offered to pay the District $10,000.00 to cover the cost of the repairs. The District intends to perform the repairs along with other repair work on the Intercepting Sewer. Upon completion of the work, Edgewood Valley would be released from any District claims relating to the damage identified during the inspection. The Engineering Department finds the proposed settlement to be reasonable and in the best interest of the District, as the District will avoid court costs and legal fees.

 

Therefore, the Engineering Department respectfully requests that the Board of Commissioners grant authority to settle the District’s potential claim against Edgewood Valley Country Club arising out of damage to the District’s Southwest Side Intercepting Sewer 17-C in the Village of LaGrange, Illinois, in the amount of $10,000.00. Additionally, the Engineering Department requests authority to execute all documents as may be necessary to effectuate this settlement after it is approved by the General Counsel as to form and legality.
