Authorization to negotiate and enter into an intergovernmental agreement with Maine Township for Contract 12-056-AF, Flood Control Project on Farmers Creek

Dear Sir:

 

Authorization is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with Maine Township for Contract 12-056-AF, Flood Control Project on Farmers Creek.  The IGA will define various responsibilities associated with the proposed improvements including construction and perpetual maintenance.

 

The proposed project will lower the normal water level at Lake Mary Anne, located within Maine Township at the upstream portion of Farmers Creek, to provide additional stormwater storage and protect adjacent homes from recurring flood damage.  The scope of work includes construction of a new outlet structure, junction structure, and storm sewer across Golf Road.  The existing channel of Farmers Creek, downstream of the new storm sewer, will also be stabilized and restored.

 

The terms of the IGA will include design and construction of the improvements by the District, and future maintenance of the improvements outside of Illinois Department of Transportation (IDOT) right-of-way by Maine Township.  The District has requested that IDOT maintain proposed improvements within their right-of-way.  IDOT has indicated it will provide a letter of confirmation upon completion of their review of our project design. 

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate an IGA with Maine Township for the above captioned project, and that the Chairman of the Committee on Finance, Executive Director, and Clerk be authorized to execute said IGA on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance of the agreement, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
