Title

Authority to grant a second 10-year, non-exclusive easement extension to Skokie Eruv Committee, Inc. to continue to operate and maintain eight decorative poles and two 48-inch chain link fences upon and over District real estate along the west bank of the North Shore Channel between Oakton Street and Church Street in Skokie, Illinois.  Consideration shall be a nominal fee of $10.00

Dear Sir:

 

Since August 15, 1991, the Skokie Eruv Committee, Inc. (“Skokie Eruv”) has been granted a series of non-exclusive easements to construct, reconstruct, operate, maintain, repair and remove decorative poles and two 48-inch chain link fences upon and over District real estate along North Shore Channel Parcels 3.05, 3.06, 4.03, 4.04 and 6.07 (the “Parcels”). The current non-exclusive Easement Agreement was entered into in 2001 and, as extended, expires August 14, 2021.

 

The Skokie Eruv has now requested a second 10-year, non-exclusive easement extension to continue to operate and maintain eight decorative poles and two 48-inch chain link fences upon and over the Parcels, under the same terms and conditions. The Skokie Eruv uses existing utility poles, utility type poles, wires and chain link fencing to designate the Eruv’s boundary lines.

 

The District’s technical departments have reviewed Skokie Eruv’s request for continued use of the easement and have no objections thereto.

 

The Skokie Eruv will continue to maintain liability and property damage insurance in accordance with the District's standard insurance coverage requirements. Previously, the District’s Board of Commissioners waived the required environmental contamination coverage, the performance bond and document preparation fee. Skokie Eruv has again requested that the District waive these requirements because neither the eight decorative concrete poles, nor the chain link fences present an environmental contamination risk on the Parcels.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it grant a second 10-year, non-exclusive easement extension to Skokie Eruv Committee, Inc. to continue to operate and maintain eight decorative poles and two 48-inch chain link fences upon and over District real estate along the west bank of the North Shore Channel between Oakton Street and Church Street in Skokie, Illinois.  Consideration shall be a nominal fee of $10.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said second easement extension agreement after it is approved by the General Counsel as to form and legality.
