Authorization is requested to amend the Intergovernmental Agreement (IGA) with the Village of Lyons (Village) for the construction, operation, and maintenance of the Green Alleys Water Management Project in Lyons, SSA (20-IGA-12).

 

On September 17, 2020, the Board of Commissioners granted authority to enter into an IGA with and make payment to the Village for the construction, operation, and maintenance of the captioned project, in an amount not to exceed $500,000.00. The IGA between the District and Village was fully executed on October 23, 2020.

 

The IGA states that the Village will construct two permeable alleys in the following locations: the two “T” alleys bounded by 44th Street to the north, Joliet Avenue to the east, 45th Street to the south, and Lawndale Avenue to the west. The two permeable alleys will provide a minimum of 126,212 gallons of stormwater storage for which the District will seek credit under the GI requirements of the District’s Consent Decree, subject to approval by the United States Environmental Protection Agency. The IGA also states that the District will reimburse the Village for 62.6% of the total construction cost of the project, in an amount not to exceed $500,000.00. The Village submitted additional alleys in its 2019 application to the District, but proceeded with only two alleys due to budgetary constraints.

 

Since the IGA was executed, the Village awarded a contract to construct the above mentioned two permeable alleys at an award amount 34% lower than the Village’s cost estimate. To take advantage of these cost savings, the Village revisited its original 2019 proposal and determined it can construct one additional permeable alley (approximately the length of two standard-sized alleys) under a separate bid without exceeding the District’s maximum reimbursement amount of $500,000.00 and 62.6% contribution. The proposed alley is bounded by Christie Avenue to the north, Joliet Avenue to the east, 44th Street to the south, and Lawndale Avenue to the west.

 

In accordance with the District’s Affirmative Action Ordinance, the goals to be applied by the Village to the total amount of reimbursement provided by the District for this project are 20 percent for Minority-owned Business Enterprises, 10 percent for Women-owned Business Enterprises, 10 percent for Small Business Enterprises, and 3 percent for Veteran-owned Business Enterprises. The Village has indicated that it will apply the District’s goals to its entire construction contract. The terms of the IGA include a provision for the District to withhold funds from reimbursement requests if the Village is not meeting the goals applied to the District’s funding amount.

 

The additional permeable alley will provide a minimum of 54,464 gallons of stormwater storage, contributing to a total of 180,676 gallons of stormwater storage for the three permeable alleys for which the District will seek credit under the GI requirements of the District’s Consent Decree, subject to approval by the United States Environmental Protection Agency.

 

Based on the foregoing, the Engineering Department recommends that the District be authorized to amend the IGA with the Village for the construction, operation, and maintenance of the Green Alleys Water Management Project in the Village of Lyons, Illinois.

 

It is requested that the Board of Commissioners authorize and direct the Chairman of the Committee on Finance and Clerk to execute the amendment to the IGA after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
