Title
Authority to grant a 25-year, 3,158± sq. ft. non-exclusive air rights easement to Illinois Bell Telephone Company, LLC, d/b/a AT&T Illinois to continue to cross the Des Plaines River and Main Channel with conduit and cable contained within a 3-foot-wide structure attached to the underside of the Willow Springs Road Bridge in Willow Springs, Illinois. Consideration shall be an initial annual fee of $5,000.00

Dear Sir:
On September 3, 1998, the District’s Board of Commissioners granted to Ameritech n/k/a Illinois Bell Telephone Company, LLC, d/b/a AT&T Illinois (“AT&T”) a 3,123 sq. ft. air rights easement to cross the Des Plaines River and Main Channel with conduit and cable contained within a 3-foot-wide structure attached to the underside of the Willow Springs Road Bridge, in Willow Springs, Illinois. The Willow Springs Road Bridge is owned and maintained by the Illinois Department of Transportation (“IDOT”). The easement expires September 20, 2022. The current annual easement fee is $2,726.43.
AT&T has requested a new 25-year easement to continue to cross the Des Plaines River and Main Channel with conduit and cable contained within a 3-foot-wide structure attached to the underside of the Willow Springs Road Bridge in Willow Springs, Illinois.
The District’s technical departments have reviewed AT&T’s request and have no objections thereto. An initial annual easement fee of $5,000.00 is recommended, as 10% of the fair market value of the easement premises would yield a fee less than the District’s minimum easement fee of $5,000.00.
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the grant of a 25-year, 3,158± sq. ft. non-exclusive air rights easement to Illinois Bell Telephone Company, LLC, d/b/a AT&T Illinois to continue to cross the Des Plaines River and Main Channel with conduit and cable contained within a 3-foot-wide structure attached to the underside of the Willow Springs Road Bridge in Willow Springs, Illinois. Consideration shall be an initial annual fee of $5,000.00.
It is also requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement agreement after it is approved by the General Counsel as to form and legality.
