Dear Sir:

 

Authorization is requested to amend the Intergovernmental Agreement (IGA) with the Berwyn Park District (Park District) for the construction, operation, and maintenance of a Permeable Parking Area and Bioswale at Liberty Green Annex in, SSA (20-IGA-02).

 

On September 3, 2020, the Board of Commissioners granted authority to enter into an IGA with and make payment to the Park District for the construction, operation, and maintenance of the above referenced project, in an amount not to exceed $85,000.00. The IGA between the District and Park District was fully executed on October 23, 2020.

 

The IGA states that the Park District will construct a bioswale and a permeable off-street parking area using permeable pavers at a proposed park located at 6514 West 27th Place, Berwyn, Illinois. The bioswale and permeable parking area will provide a minimum of 10,577 gallons of stormwater storage for which the District will seek credit under the GI requirements of the District’s Consent Decree, subject to approval by the United States Environmental Protection Agency. Due to the amount requested, this IGA falls under the threshold for Affirmative Action Requirements.

 

Since the IGA was executed, the Park District revisited their planned projects and determined that their limited funding should be used instead to better improve their existing parks. The Park District informed the Engineering Department that they would no longer be constructing the proposed park, and therefore would not be moving forward with the bioswale and permeable parking area as proposed in their application. The Park District proposed an alternate project that would help mitigate flooding in one of their existing parks by constructing three bioretention areas within the park. A preliminary engineering analysis determined that this alternate project could provide over four times the gallons of stormwater storage. In addition, the Park District was willing to increase their cost share for the project, and the District’s maximum contribution to the construction of the project will remain at $85,000.00. The total cost of the alternate project, including design and permitting, is $170,000.00.

 

The alternate project of three bioretention areas is located at Proksa Park at 3001 Wisconsin Ave, Berwyn, Illinois, and will provide an estimated 48,232 gallons of stormwater storage for which the District will include in its annual reporting to the United States Environmental Protection Agency for the GI portion of the District’s consent decree.

 

Based on the foregoing, the Engineering Department recommends that the District be authorized to amend the IGA with the Berwyn Park District for the construction, operation, and maintenance of a Permeable Parking Area and Bioswale at Liberty Green Annex in Berwyn, Illinois. The amended title of the IGA will be as follows: the Proksa Park Green Infrastructure Improvements in Berwyn, SSA.

 

It is requested that the Board of Commissioners authorize and direct the Chairman of the Committee on Finance and Clerk to execute the amendment to the IGA after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
