Authority to negotiate an Intergovernmental Agreement with the City of Palos Hills for the design, construction, operation and maintenance of the Roberts Road Drainage Improvements in Palos Hills, Illinois

Dear Sir:

 

Authorization is requested to negotiate an Intergovernmental Agreement (IGA) with to the City of Palos Hills (City) for the design, construction, operation and maintenance of the Roberts Road Drainage Improvements in Palos Hills, Illinois.

 

On June 7, 2018, the Board of Commissioners authorized the District to assist various local municipalities and townships with Phase II Stormwater Management Projects. Among the projects approved was a conceptual project submitted by the City to investigate and develop feasible alternatives to address flooding along Roberts Road in Palos Hills. On July 11, 2019, the Board of Commissioners authorized the District to issue a purchase order and enter into an agreement with Hey and Associates, Inc. (Hey) for professional engineering services to conduct preliminary engineering for Contract 18-251-5F Roberts Road Drainage Improvements in Palos Hills, Illinois. In coordination with the City, a plan was developed to connect Roberts Road storm sewers to the Lucas Diversion Ditch through conveyance improvements along 101st Street, 103rd Street, and 78th Avenue. The City has identified additional funding for the project, and requested the District prepare an IGA to advance the project. The terms of the IGA between the District and the City will include final design, construction, operation and maintenance responsibilities to be assumed by the City with the District providing funds for a portion of the construction costs. Total funding assistance to be provided by the District will be finalized during negotiations between the District and City. The IGA will also require the City to advertise and award the construction contracts in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority to negotiate an IGA with the City. Once the parties agree in principle, authority to enter into the IGA will be sought from the District’s Board of Commissioners.
