Dear Sir:

 

Daniel Mikso is a Treatment Plant Operator III working at the Calumet Water Reclamation Plant. On September 4, 2019, he reported he sustained an injury to his left shoulder while practicing for a safety event for the District’s Operation Challenge Team. He reported using a manual winch to lift a one-hundred-pound manikin from a confined space. He sought initial treatment with a physician from Loyola Health for his left shoulder on November 5, 2019. An MRI performed on November 20, 2019 revealed a full thickness rotator cuff tear of the left shoulder. On January 22, 2020, the employee underwent a surgical procedure to repair his left shoulder. He was disabled from work at this time.  He underwent a course of physical therapy following his surgery. He was able to return to restricted work on February 24, 2020. He was disabled from work again effective August 24, 2020, until returning to full duty work on November 23, 2020.

 

Mr. Mikso was paid 17.60 weeks of lost time benefits totaling $26,925.20.      

 

Mr. Mikso filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can now be settled for a total of $73,210.38, representing approximately 17.5% loss of use of the person as a whole.   This settlement will close out future lost time and medical benefits associated with this injury.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.
