Title

Authority to grant Comcast of Illinois IV, Inc. a 25-year, approximately 10’ x 534’ non-exclusive easement to continue to operate an aerially suspended cable transmission line and appurtenances thereto on District real estate located east of McCormick Boulevard and west of Kedzie Avenue in Lincolnwood, Illinois; North Shore Channel Parcels 7.06 and 7.07. Consideration shall be an initial annual fee of $5,000.00

Dear Sir:

 

Since April 8, 1999, Media One Acquisitions of Northern Illinois, Inc., n/k/a Comcast of Illinois IV, Inc. (“Comcast”), has operated and maintained an aerially suspended cable transmission line and appurtenances thereto on North Shore Channel (“NSC”) Parcels 7.06 and 7.07. The cable transmission line begins east of McCormick Boulevard between Pratt Avenue and Touhy Avenue, and traverses easterly over the North Shore Channel to Kedzie Avenue, in Lincolnwood, Illinois. The current easement expires April 7, 2024, and the current annual easement fee is $2,125.97.

 

Comcast has requested a new 25-year easement to continue to operate and maintain its aerially suspended cable transmission line and appurtenances thereto. NSC Parcel 7.06 is leased to the Village of Lincolnwood and NSC Parcel 7.07 is leased to the Chicago Park District. The leases allow for public utility easements within the leaseholds.

 

The District’s technical departments have reviewed this request and have no objections thereto. It is recommended that an initial annual easement fee of $5,000.00 be assessed for the 25-year easement as the fair market value of the easement premises would yield a fee less than the District’s minimum fee of $5,000.00.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it grant to Comcast of Illinois IV, Inc. a 25-year, approximately 10’ x 534’ non-exclusive easement to continue to operate an aerially suspended cable transmission line and appurtenances thereto on District real estate located east of McCormick Boulevard and west of Kedzie Avenue in Lincolnwood, Illinois; North Shore Channel Parcels 7.06 and 7.07. Consideration shall be an initial annual fee of $5,000.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement after it is approved by the General Counsel as to form and legality.
