Dear Sir:
Authorization is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with and make payment to the City of Des Plaines (City) for the design, construction, operation, and maintenance of the Craig Manor Drainage System Improvements in Des Plaines (23-IGA-33), in an amount not to exceed $1,000,000.00.
As detailed in a Report on Stormwater Partnership Program (SPP) Project Submittals presented to the Board of Commissioners on April 6, 2023, between September 2022 and January 2023 the District solicited SPP project proposals from municipalities, townships, and other governmental agencies for District assistance, and received 31 applications. Of the 31 project applications received, the Engineering Department identified 10 projects that could be advanced through partnerships based on the anticipated funding available in 2023 for the District’s stormwater management program, including the subject project. Under this project, the City proposes to construct 2.5 acre-feet of underground detention within Craig Manor Park along with box culverts relief sewers to convey flow into the underground detention basin and 12-inch diameter storm sewers to convey flow out of the detention basin, as depicted in the attached exhibit. The project is expected to mitigate flooding in the project area, benefitting approximately 11 structures and reducing impacts on local roadways by providing detention during high intensity storms.
The terms of the IGA will include payment by the District towards construction costs in an amount not to exceed $1,000,000.00. The total project cost, including design and permitting, is $3,880,225.80. Partial payments to the City, to be set forth in the IGA, will be made at predefined intervals during construction, which is anticipated to commence in 2024. The City has contributed to engineering and other design-related costs of the project, and will assume responsibility for construction, operation, and maintenance of the project. The City will also be solely responsible for any change orders. The IGA will contain provisions that allow the District to review the project’s design and perform inspections after construction. The IGA will also require the City to advertise and award the construction contracts in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements.
The Affirmative Action goals to be applied will conform with the current requirements of the District’s Appendix D upon execution of this IGA. After construction, the Affirmative Action utilization on this project will be provided in an annual report summarizing goal attainment on stormwater partnerships.
Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate and enter into an IGA with and make payment to the City in an amount not to exceed $1,000,000.00. It is further requested that the Chairman of the Committee on Finance, Executive Directo, and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
Funds from Account 501-50000-612400 requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
