Authorization is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with and make payment to the Village of Brookfield (Village) for the design, construction, operation, and maintenance of the Burlington Avenue Storm Sewer Improvements in Brookfield (23-IGA-31), in an amount not to exceed $1,075,745.00.

 

As detailed in a Report on Stormwater Partnership Program (SPP) Project Submittals presented to the Board of Commissioners on April 6, 2023, between September 2022 and January 2023 the District solicited SPP project proposals from municipalities, townships, and other governmental agencies for District assistance, and received 31 applications. Of those 31 project applications, the Engineering Department identified 10 projects that could be advanced as partnerships through the District’s stormwater management program, including the subject project. Under this project, the Village proposes constructing new storm sewers and an outfall to Salt Creek, as depicted in the attached exhibit. The project is expected to mitigate flooding, benefitting approximately 115 structures, reducing the impact of street flooding.

 

The proposed storm sewer improvements are part of a larger roadway improvement project on Burlington Avenue, for which the Village will receive federal Surface Transportation Program funding through the Illinois Department of Transportation (IDOT). As a result, the project will be bid, awarded, and constructed through IDOT, which will oversee contract administration and construction of the overall project. Since IDOT will be managing the construction, its contracting requirements will govern, including their provisions for Disadvantaged Business Enterprise participation applied to the entire project. IDOT’s tailored Disadvantaged Business Enterprise participation goal for this project is 21 percent of the overall project cost and not just the portion funded by the District. In keeping with the Board’s request to receive summary reports documenting the attainment of diversity goals across District stormwater partnerships, the Village will be required to provide information on the goal attainment for this project, which will be provided in an annual report summarizing goal attainment on stormwater partnerships.

 

The terms of the IGA will include payment by the District towards construction costs in an amount not to exceed $1,075,745.00. The total cost of the overall improvements project, including design and permitting, is $5,835,891.00. After the IGA is executed, a lump-sum payment will be made by the District to the Village in accordance with the joint agreement between IDOT and the Village. The Village has contributed to engineering and other design-related costs, and will assume responsibility for the operation and maintenance of the project. The Village will also be solely responsible for any change orders. The IGA will contain provisions that allow the District to review the project’s design and perform inspections after construction.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate and enter into an IGA with and make payment to the Village in an amount not to exceed $1,075,745.00. It is further requested that the Chairman of the Committee on Finance, Executive Director and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds for this project are subject to appropriation in 2023 in Account 501-50000-612400. Funds requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
