Authority to negotiate an Intergovernmental Agreement for the design, construction, operation, and maintenance of the Thorn Ditch Flood Mitigation Project in South Holland, Illinois

Dear Sir:

 

Authorization is requested to negotiate an Intergovernmental Agreement (IGA) with the Village of South Holland (Village) for the design, construction, operation, and maintenance of the Thorn Ditch Flood Mitigation Project in South Holland, Illinois.

 

On June 7, 2018, the Board of Commissioners authorized the District to assist various local municipalities and townships with Phase II Stormwater Management Projects. Among the projects approved was a conceptual project submitted by the Village to investigate and develop feasible alternatives to address flooding along Thorn Ditch in South Holland. On September 5, 2019, the Board of Commissioners (Board) authorized the District to issue a purchase order and enter into an agreement with ESI Consultants, Ltd., for professional engineering services to conduct preliminary engineering for Contract 18-252-5F Thorn Ditch Flood Mitigation Project in South Holland, Illinois. In coordination with the Village, a plan was developed to replace existing culverts along Thorn Ditch and construct stormwater storage at local parks to protect residences near the ditch from flooding. Additional funding has been identified for the project under the American Rescue Plan Act (ARPA) Subrecipient Agreement between Cook County and the District, authorized by the Board on June 15, 2023.

 

In order to advance this project, the District will prepare an IGA to define the roles and responsibilities of the Village including final design, construction, operation, and maintenance responsibilities, with the District providing funds for the construction costs, of which $1,500,000.00 will be reimbursed to the District by Cook County under the ARPA Subrecipient Agreement. The total cost of the project is estimated to be between $3,000,000 and $4,000,000. Total funding assistance to be provided by the District will be finalized during negotiations between the District and the Village. The IGA will also require the Village to advertise and award the construction contracts in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements, in addition to requirements set forth in the ARPA Subrecipient Agreement.

 

Based on the foregoing, it is requested that the Board grant authority for the District to negotiate an IGA with the Village for the design, construction, operation, and maintenance of the Thorn Ditch Flood Mitigation Project. If the parties agree in principle, authority to enter the IGA will be sought from the District’s Board at a later date.
