Dear Sir:
Authorization is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with and make payment to the Northfield Township Road District (Road District) for the design, construction, operation, and maintenance of Citation Lake Stormwater Improvements in Northfield Township, Illinois (23-IGA-44), in an amount not to exceed $3,000,000.00.
On June 7, 2018, the Board of Commissioners authorized the District to assist various local municipalities and townships with Phase II Stormwater Management Projects. Among the projects approved was a conceptual project submitted by the Township seeking assistance from the District in the form of engineering analysis and design of alternatives to address flooding issues within its jurisdiction. On July 11, 2019, the Board of Commissioners authorized the District to issue a purchase order and enter into an agreement with Engineering Resource Associates for professional engineering services to conduct preliminary engineering for Contract 18-082-5F Citation Lake Stormwater Improvements in Northfield Township, Illinois. In coordination with the Township, a plan was developed to provide stormwater detention improvements through the installation of stormwater storage vaults under specific sections of the roadway and the installation of new storm sewers to convey the runoff more effectively. The project is expected to mitigate flooding, benefitting approximately 113 structures and reduces the impact of street flooding.
In order to advance this project, the District will prepare an IGA to define the roles and responsibilities of the Road District, including final design, construction, operation, and maintenance. The terms of the IGA will include payment by the District towards construction costs in an amount not to exceed $3,000,000, of which $1,500,000.00 will be reimbursed to the District by Cook County (County) under the American Rescue Plan Act (ARPA) Subrecipient Agreement between the County and the District, authorized by the Board of Commissioners on June 15, 2023. The IGA will also require the Road District to advertise and award the construction contracts in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements, in addition to requirements set forth in the ARPA Subrecipient Agreement. Partial payments to the Road District will be made at predefined intervals during construction, which is anticipated to commence in 2025.
The Affirmative Action goals to be applied will conform with the current requirements of the District’s Revised Appendix D upon execution of this IGA. After construction, the Affirmative Action utilization on this project will be provided in an annual report summarizing goal attainment on stormwater partnerships.
Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate and enter into an IGA with and make payment to the Road District in an amount not to exceed $3,000,000.00. It is further requested that the Chairman of the Committee on Finance, Executive Director, and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters, and by the General Counsel as to form and legality.
Funds from Account 501-50000-612400 requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
