Authority to settle the Illinois Workers’ Compensation Claim of James McManamon vs. MWRDGC, Claim Number 23WC022959 in the sum of $108,704.76, Account 901-30000-601090

Dear Sir:
James McManamon was a Structural Ironworker at the O’Brien Water Reclamation Plant. He is currently on a Leave of Absence. On, April 13, 2022, Mr. McManamon reported that while unloading scaffolding from a truck, he tripped over a gate rail chain, caught his foot on the rail and fell over onto concrete, landing on both hands and injuring his right shoulder. The employee was seen at the Industrial Clinic on April 14, 2022, and was diagnosed with bilateral wrist contusion. X-rays revealed an avulsion fracture of the ulnar styloid. The employee treated conservatively with a wrist brace, and he was placed on light duty work. On May 26, 2022, an MRI of the right shoulder revealed a massive cuff tear. The employee was placed off of work on July 4, 2022, and had surgical repair of the right shoulder on July 6, 2022. The employee returned to work on September 13, 2022.
Mr. McManamon was paid 10.2 weeks of lost time benefits totaling $14,755.58.
Mr. McManamon filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can be settled for $108,704.76 representing approximately 15% loss of person as a whole for the right shoulder and approximately 20% loss of use of the right hand. This settlement will close out any future lost time benefits associated with this injury.
The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
