Report on the Settlement of Workers’ Compensation Claims and Miscellaneous Claims under $10,000.00

Dear Sir:

 

The following matters were settled upon the recommendation of the Director of Human Resources and the approval of the Executive Director:

 

1.                     Settlement of Auto Liability Claim of Miguel Rojas, Claim No: A/P 1549, in the amount of $2,903.77.

 

While driving on Austin Boulevard at the Stickney WRP on November 7, 2023, Mr. Roja’s personal vehicle was allegedly struck and damaged by a District owned vehicle. This settlement satisfies the total damages sought to repair  Mr. Rojas’ personal vehicle.

 

2.                     Settlement of Liability Claim of Ira Woody, Claim No: A/P 1546, in the amount of $3,355.73.

 

While driving into the main entrance of the O’Brien WRP on February 1, 2024, Mr. Woody’s personal vehicle was allegedly struck and damaged on the roof by the arm of the gate coming down on his vehicle. This settlement satisfies the total damages sought to repair the vehicle.

3.                     Settlement of Liability Claim of Edward Jankun, Claim No: A/P 1548, in the amount of $108.00.

 

While driving on B Street at the Stickney WRP on April 23, 2024, the front-right wheel of Mr. Jankun’s personal vehicle was allegedly damaged after driving over several pieces of iron on the ground. This settlement satisfies the total damages sought to repair the vehicle.

 

4.                     Settlement of Workers’ Compensation Claim of Steve Hawthorne, Claim Case No. 22WC012963, in the amount of $1.00.

 

Steven Hawthorne, a Maintenance Laborer A Shift at the Stickney WRP, alleged a March 23, 2022 work related injury to his right shoulder and lower back while working on a District train that struck a semi-truck that allegedly failed to yield at the railroad crossing, causing Mr. Hawthorne to be thrown backwards.  Mr. Hawthorne did not lose any time from work. Mr. Hawthorne retained an attorney for a third-party claim against the semi-truck driver.  The District will agree to waive its subrogation lien rights on the third-party recovery in order to settle the permanency aspect of this claim for $1.00. Settlement in the amount of $1.00 will also close out any future lost time benefits as well as any future medical benefits.
