Authority to negotiate and enter into an Intergovernmental Agreement with the Village of Kenilworth to relocate drop chambers and other structures that connect to North Shore Intercepting Sewer 7 in the Village of Kenilworth, Illinois

Dear Sir:

 

The District owns and operates an intercepting sewer known as the North Shore Intercepting Sewer 7 (“Interceptor”). The Interceptor is located along Green Bay Road and serves several communities including the Village of Kenilworth (“Kenilworth”). Certain drop chambers, pipes, and structures that connect to the Interceptor (“Facilities”) are located beneath a vacant lot near the intersection of Green Bay Road and Roger Avenue in Kenilworth. Kenilworth would like to make that vacant lot available for residential redevelopment.

 

To make the lot suitable for redevelopment, Kenilworth has requested to relocate the Facilities from beneath the vacant lot. The proposed relocation includes the construction of new drop chambers and the abandonment of existing drop chambers.

 

An Intergovernmental Agreement (“IGA”) with Kenilworth is necessary to ensure coordination between the District and Kenilworth relating to the relocation of these Facilities. The purpose of the IGA is to ensure that construction, abandonment, ownership, operation, and maintenance responsibilities are clearly established, that District infrastructure is protected, and that sewer services continue to be provided at all times. Under the IGA, the District will not be responsible for any costs or fees in the construction of any new Facilities or the abandonment of any existing Facilities. The new Facilities shall be constructed to the District’s engineering standards.

 

In addition to the IGA, the redevelopment of the vacant lot will be subject to a Watershed Management Ordinance (“WMO”) permit. Once a WMO permit application is submitted, that request will be reviewed by the technical departments.

 

It is hereby requested that the Board of Commissioners authorize the District to negotiate and enter into an Intergovernmental Agreement with the Village of Kenilworth to relocate drop chambers and other structures that connect to North Shore Intercepting Sewer 7 in the Village of Kenilworth, Illinois.
