Dear Sir:

 

Anthony Jordan is a Carpenter at the O’Brien Water Reclamation Plant. On September 22, 2021, the employee reported that he stepped down in the Grit Building while carrying a heavy bucket and felt low back pain. He went to the industrial clinic on September 23, 2021, and initially treated conservatively with restricted work, medication, and physical therapy. On October 15, 2021, the employee had an MRI of his lumbar spine, which revealed a mild disk bulge at L5/S1 and mild right and moderate left foraminal stenosis. He treated conservatively with time off of work and physical therapy. He was off work starting on January 6, 2022. He returned to full duty work on April 28, 2022.

 

On July 29, 2022, the employee reported that he was wheeling a cart with a heavy jack hammer on top of it and hurt his back. He was seen at the industrial clinic on the date of injury and was given work restrictions. His doctor took him off work effective August 22, 2022. An MRI was performed on August 29, 2022, revealing grossly stable mild right and moderate left foraminal stenosis L5/S1, mild stenosis at L3-4 with no mention of protrusion. He treated with medication and physical therapy. The employee returned to work on September 21, 2022.

 

Mr. Jordan was paid 16.0 weeks of lost time benefits for the 2021 injury totaling $21,375.34 and was paid 4.4 weeks of lost time benefits totaling $5,988.65 for the 2022 injury.     

 

Mr. Jordan filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can be settled for $35,141.62 representing approximately 7.5% loss of person as a whole. This settlement will close out any future lost time and medical benefits associated with this injury.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
