Authorization is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with and make payment to the Illinois Department of Transportation (IDOT) for the design, construction, operation, and maintenance of the I-290 Frontage Road Sewer and Outfall in Maywood (24-IGA-23), in an amount not to exceed $5,707,000.00.

 

On March 15, 2018, the Board of Commissioners authorized the District to negotiate and enter into a Memorandum of Understanding with IDOT for the purpose of establishing a partnership to address stormwater issues in Cook County. The intent of the Memorandum of Understanding is to streamline negotiations, permitting, and collaboration on projects performed by the District and IDOT to address flooding issues, including the subject project.

 

Under this project, IDOT proposes to construct a new large diameter trunk storm sewer along the I-290 Frontage Road with a dedicated outfall to the Des Plaines River, as depicted in the attached exhibit. This work is part of IDOT’s overall improvement plans of I-290, from west of US 12/20/45 (Mannheim Road) to Racine Avenue, for which IDOT has completed the preliminary engineering and environmental studies (Phase I). IDOT has also funded final design (Phase II) services for drainage improvements for the project area and intends to initiate construction of these improvements in 2025. Additionally, with support from the District, IDOT secured a grant for $8,646,190.00 from the Federal Highway Administration through its Promoting Resilient Operations for Transformative, Efficient, and Cost-Saving Transportation Program for the I-290 Frontage Road Sewer project, which provides significant federal funding towards these stormwater improvements. The I-290 Frontage Road Sewer and Outfall will provide an outlet to the ongoing flood relief projects that the Village of Maywood is currently advancing with the District’s support.

 

The terms of the IGA will include IDOT constructing the new large diameter trunk storm sewer along the I-290 Frontage Road and the outfall to the Des Plaines River. IDOT will be responsible for obtaining all permits and property interests necessary to construction the project. IDOT will coordinate with the Village of Maywood to establish the maintenance responsibilities of the completed project. The District will not own nor maintain the completed project. The District will cost share in the design and construction of this project in an amount not to exceed $5,707,000.00. Since IDOT will be managing the design and construction, its contracting requirements will govern, including their provisions for Disadvantaged Business Enterprise participation applied to the entire project, which is expected to cost $15,320,000.00.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate and enter into an IGA with and make payment to IDOT in an amount not to exceed $5,707,000.00 for the above captioned project. It is further requested that the Chairman of the Committee on Finance, the Executive Director, and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds for this project are subject to appropriation in 2024 in Account 501-50000-612400. Funds from Account 501-50000-612400 requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
