Dear Sir:
On May 16, 2024, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 24-025-11 furnish and deliver plumbing pipe, fittings and valves to various locations for a one-year period, beginning approximately September 1, 2024, and ending August 31, 2025.
In response to a public advertisement of May 29, 2024, a bid opening was held on June 25, 2024. The bid tabulation for this contract is:

During the review Group J it was revealed that some of the quantities were misstated in the contract documents resulting in the total cost of Group J to be over the estimate of $23,000.00. The District believes that the quantities should be revised and the contract will be re advertised. Therefore, the Director of Procurement and Materials Management has rejected both bids in the publics’ best interest and has informed Ferguson Enterprises, LLC d.b.a. Columbia Pipe & Supply and Marco Supply Company, Inc., d.b.a. Johnson Pipe & Supply Corp. of this action.
Marco Supply Company, Inc., d.b.a. Johnson Pipe & Supply Corp., the lowest responsible bidder for Groups A, C, D, F, H, I, L, M, N, and O, is proposing to perform the contract in accordance with the specifications. The estimated cost for Groups A, C, D, F, H, I, L, M, N, and O of this contract was $416,000.00, placing the total bid of $381,634.48 approximately 8.26 percent below the estimate.
Ferguson Enterprises, LLC d.b.a. Columbia Pipe & Supply, the lowest responsible bidder for Groups B, E, G, and K, is proposing to perform the contract in accordance with the specifications. The estimated cost for Groups B, E, G, and K of this contract was $108,000.00, placing the total bid of $82,599.49 approximately 23.52 percent below the estimate.
The Multi-Project Labor Agreement (MPLA) is not applicable to this contract because it does not fall under the provisions of the MPLA.
The Affirmative Action Ordinance, Revised Appendix D and Appendix V, will not be included in this contract because the estimate, per each individually awarded group of the contract, is less than the minimum threshold established by Section 4 of the Affirmative Action Ordinance.
No bid deposit was required for this contract.
Purchase orders will be issued for the material as required. Payment will be based on the unit cost as indicated in the contract documents
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 24-025-11, Groups A, C, D, F, H, I, L, M, N, and O to Marco Supply Company, Inc., d.b.a Johnson Pipe & Supply Corp., in an amount not to exceed $381,634.48, and Groups B, E, G, and K to Ferguson Enterprises, LLC d.b.a. Columbia Pipe & Supply LLC, in an amount not to exceed $82,599.49.
Funds are available in Account 101-20000-623090, 623170, 623270, and 623570.
