Body
Dear Sir:
Commonwealth Edison Company (“ComEd”) has requested a 26-year, approximately 20’ x 1080’ non-exclusive easement to install, operate, maintain, repair, and replace electrical transmission lines and related facilities on District real estate located south of the Chicago Sanitary and Ship Canal and east of Illinois Route 83 in Lemont, Illinois, known as Main Channel Parcel 26.01. The purpose of the easement is to extend electrical service for the District’s tenant, Holcim (US) Inc. (“Holcim”). Holcim leases Main Channel Parcels 26.01 and 26.04 for bulk material storage and barging.
The District’s technical departments have reviewed ComEd’s request and have no objections thereto. An initial annual easement fee in the amount of $5,000.00 is recommended, as the pro-rata share of 10% of the fair market value of the land would yield a fee less than the District’s minimum fee of $5,000.00.
It is requested that the Executive Director recommend to the Board of Commissioners that it grant a 26-year, approximately 20’ x 1080’ non-exclusive easement to Commonwealth Edison Company to install, operate, maintain, repair, and replace electrical transmission lines and related facilities on District real estate located south of the Chicago Sanitary and Ship Canal and east of Illinois Route 83 in Lemont, Illinois; Main Channel Parcel 26.01. Consideration shall be an initial annual fee of $5,000.00.
It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement after it is approved by the General Counsel as to form and legality.
Requested, Susan T. Morakalis, General Counsel, STM:BJD:KHY
Recommended, Brian A. Perkovich, Executive Director
