TRANSMITTAL LETTER FOR BOARD MEETING OF NOVEMBER 7, 2024

COMMITTEE ON JUDICIARY

Mr. Brian A. Perkovich, Executive Director

Title

Authority to settle the Workers’ Compensation Claim of Michael Dermody vs. MWRDGC, Claim number 23 WC 28669, Illinois Workers’ Compensation Commission (IWCC), in the sum of $30,746.10 Account 901-30000-601090

Body

Dear Sir:

Michael Dermody is an Operating Engineer I working at the Egan Water Reclamation Plant. On October 24, 2023, the employee reported that while working on a ladder to reach a steam line, the line broke, released steam and caused him to fall off the ladder.  Mr. Dermody was transported by ambulance to the Emergency Room. He was diagnosed with a fractured right rib, contusion of the right scapula, and received 10 staples into his head laceration. Mr. Dermody was off work effective October 25, 2023, and returned on December 18, 2023.

Mr. Dermody was paid a total of 7.6 weeks of lost time benefits totaling $11,321.95.

Mr. Dermody filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can be settled for $30,746.10, representing approximately 5% loss of use of the person as a whole and an additional 5 weeks of disfigurement. This settlement will close out any future lost time and medical benefits associated with this injury.

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Thaddeus J. Kosowski, Director of Human Resources, TJK:BLW:DMG
