Authority to execute a second amendment to the Intergovernmental Agreement with the Village of Riverside for the Groveland Avenue Levee Improvements in Riverside, SSA (18-IGA-20)

Dear Sir:
On November 19, 2015, the Board of Commissioners authorized the District to negotiate an Intergovernmental Agreement (IGA) with the Village of Riverside (Village) to outline certain responsibilities for the Groveland Avenue Levee Improvements, SSA (18-IGA-20) (Project). This project will provide direct flood reduction benefits to an estimated 73 residential structures and will reduce storm related access impacts along local roadways. On December 20, 2018, authority to enter into an IGA with the Village was granted and the IGA was thereafter executed by the parties. On March 17, 2022, authority to amend the IGA was granted to comply with a change to the United States Army Corps of Engineers (Corps) policy that prohibits accepting third party payments. The first amendment to the IGA further allowed for the District to provide the non-federal cost-share payments to the Village and to reimburse the Village for property rights they acquire for the Project.
The IGA, executed on January 31, 2019, set the District contribution, on behalf of the Village, to the Corps, in an amount not to exceed $2,506,028.00. The IGA terms indicated the District would reimburse the Corps for 100 percent of the total non-federal sponsor cost for the Project.
On October 30, 2024, the Village sent a letter to the District asking for the District’s contribution for this project to be increased from $2,506,028.00 to $4,907,014.00. In late 2023, the Village was notified by the Corps that the cost estimate for the Project had increased from $7,160,082.00 to $18,300,000.00 due to the scope being further refined and material cost increases. The Village agreed to a final scope that increases the elevation of the floodwall and eliminates one pump station and the underground storage at a total cost of $16,508,000.00. The Corps will contribute $10,000,000.00 to this project and the Village will share in the cost increase, contributing $1,600,986.00. This will decrease the District’s overall contribution from covering 100 percent to 75.4 percent of the non-federal sponsor share of the project cost. In conjunction with floodwall project, the Village will also work with the Corps to construct a sewer separation project. While related to the floodwall project, District funds will not be used for its construction.
Based on the foregoing, it is recommended that the District be authorized to increase the District’s contribution for the Project to $4,907,014.00 and execute a second amendment to the IGA with the Village of Riverside. It is requested that the Board of Commissioners authorize and direct the Chairman of the Committee on Finance and Clerk to execute the amendment to the IGA after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
Funds for this project are subject to appropriation in 2026 and 2027 in Account 501-50000-612400. Funds requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
