TRANSMITTAL LETTER FOR BOARD MEETING OF APRIL 17, 2025

COMMITTEE ON REAL ESTATE

Mr. John P. Murray, Acting Executive Director

Title

Authority to amend lease agreement dated April 1, 1993, with the Forest Preserve District of DuPage County on approximately 266.67 acres of District real estate located between the Des Plaines River and the Main Channel in DuPage County, Illinois, known as Main Channel Parcels 24.04, 25.03, 26.07, 27.03, and 27.04, to add an approximately 30’ x 1,628’ strip of land on the western boundary of the leasehold. Consideration shall be a nominal fee of $10.00

Body

Dear Sir:

The Forest Preserve District of DuPage County (“DuPage County FPD”) leases approximately 266.67 acres of District real estate, known as Main Channel Parcels 24.04, 25.03, 26.07, 27.03, and 27.04, for public recreational purposes, including a segment of the Centennial Trail. The nominal fee lease commenced April 1, 1993, and expires December 31, 2052.

At the existing southwestern boundary line, the DuPage County FPD’s leasehold ends at Canal Bank Road in Lemont, Illinois. Canal Bank Road is a private District roadway that is shared by several District tenants, including the Cook County Forest Preserve District (“Cook County FPD”), which operates a portion of the Centennial Trail.

The Cook County FPD and DuPage County FPD plan on improving this portion of the Centennial Trail by creating a separated bike trail that runs parallel to Canal Bank Road. In order to ensure that the entire trail on District property is under lease, the DuPage County FPD leasehold must be extended from its current boundary to the DuPage County line. This extension requires an amendment to the lease agreement to add an approximately 30’ x 1,628’ strip of Canal Bank Road.

The District’s technical departments have reviewed this lease amendment request and have no objections thereto. A nominal fee of $10.00 is recommended as is customary for governmental entities using District land for a public purpose.

It is requested that the Acting Executive Director recommend to the Board of Commissioners that it authorize an amendment to the lease agreement dated April 1, 1993, with the Forest Preserve District of DuPage County on approximately 266.67 acres of District real estate located between the Des Plaines River and the Main Channel in DuPage County, Illinois, known as Main Channel Parcels 24.04, 25.03, 26.07, 27.03, and 27.04, to add an approximately 30’ x 1,628’ strip of land on the western boundary of the leasehold. Consideration shall be a nominal fee of $10.00.

It is also requested that the Acting Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said Amendment to Lease Agreement after it is approved by the General Counsel as to form and legality.

Requested, Susan T. Morakalis, General Counsel, STM:BJD:KHY:vp

Recommended, John P. Murray, Acting Executive Director
