Dear Sir:
On February 6, 2025, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 25-647-11, Boiler Tuning and Maintenance Services at Various Locations.
In response to a public advertisement of April 23, 2025, a bid opening was held on May 20, 2025. The bid tabulation for this contract is:
THE STONE GROUP, INC. $1,223,235.00
INDEPENDENT MECHANICAL INDUSTRIES, INC. $1,248,135.00
The quantities specified in the contract documents were used for the purpose of comparing bids and establishing unit prices. The total amount to be expended on this contract, should usage differ from the quantities, is not to exceed $1,200,000.00.
The associated goals for this contract are 5% Minority Business Enterprise (MBE) and/or Women Business Enterprise (WBE).
The Stone Group, Inc. (Stone Group) submitted a low bid for this contract and offered 0% MBE and 6% WBE participation. Stone Group did not comply with the Affirmative Action Revised Appendix D under section 14, Counting MBE and WBE Participation Towards Contract Goals (j), where the bidder may count payments to MBE or WBE regular dealers or manufacturers for contract goal attainment for no more than fifty (50) percent of each MBE or WBE goal. Stone Group indicated $70,000.00 to meet the WBE goal but only $35,000.00 was allowable. Therefore, Stone Group is considered non-responsive and rejected. The Director of Procurement and Materials Management has informed Stone Group of this action.
Independent Mechanical Industries, Inc., the lowest responsible bidder, is proposing to perform the contract in accordance with the specifications. The estimated cost for this contract was $1,200,000.00, placing their bid of $1,248,135.00 approximately 4% above the engineer’s estimate.
Independent Mechanical Industries, Inc., is in compliance with the Affirmative Action Ordinance, Revised Appendix D as indicated in the attached report. The bidder has committed to the following utilization goals for this contract: 5% MBE and 0% WBE. Appendix C and Appendix K do not apply.
Independent has executed the Multi-Project Labor Agreement (MPLA) certificate as required. It is anticipated that the following trades will be utilized on this contract: boilermakers and pipefitters. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
The contract shall commence upon approval of the contractor’s bond and terminate three (3) years thereafter, or upon expenditure of available funds, whichever occurs sooner.
The contract will employ approximately six (6) people for the services.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 25-647-11 to Independent Mechanical Industries, Inc., an amount not to exceed $1,200,000.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
Funds for 2025 expenditure in the amount of $205,000.00, are available in Accounts 101-67000/68000/69000-612650/623090. The estimated expenditure for 2026 is $450,000.00, for 2027 is $330,000.00, and for 2028 is $215,000.00. Funds for 2026, 2027, and 2028 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
