Authority to settle Show Cause Complaint filed in Metropolitan Water Reclamation District of Greater Chicago v. M.B.T. Transport, Inc., et al., Case No. 19 WMO 0001

Dear Sir:

 

M.B.T. Transport, Inc. (“MBT”) owns and is in possession of property located at 7753 West 47th Street in McCook, Illinois (“Site”). The District filed a Show Cause Complaint alleging MBT failed to obtain a Watershed Management Ordinance (“WMO”) permit for development that MBT performed at the Site (“Development”) and for not complying with other stormwater management requirements (e.g., stormwater detention, impacting a wetland).

 

In lieu of a hearing before a Board-designated Hearing Officer, MBT sought to bring the Site into compliance. To that end, the District issued MBT WMO Permit 19-490. With the permit issued, the District and MBT reached a proposed Settlement Agreement (“Agreement”). Under the Agreement, MBT agrees to (1) complete the development under the issued permit on or before April 30, 2027, and (2) pay $10,747.00 in civil penalties within 30 days after Board approval of the Agreement. If MBT fails to timely meet the final compliance deadline, the Agreement provides that the District may reopen its enforcement case and seek additional civil penalties. The Board-designated Hearing Officer has reviewed the settlement agreement and approved it as attached.

 

The District’s Engineering and Law Departments worked closely to effectuate a settlement that brings the Site into compliance. Accordingly, the General Counsel respectfully requests that the Board of Commissioners adopt the Hearing Officer’s approval of the proposed settlement agreement and authorize a settlement of the Show Cause Complaint filed in Metropolitan Water Reclamation District of Greater Chicago v. M.B.T. Transport, Inc., et al., Case No. 19 WMO 001, and to authorize the General Counsel to execute all other documents necessary in furtherance thereof.
