On June 16, 2022, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 07-027-3SR North Side Sludge Pipeline Replacement - Section 1, NSA, Rebid, to Joel Kennedy Constructing Corp., in an amount not to exceed $27,120,000.00, plus a five (5) percent allowance for change orders in an amount of $1,356,000.00, for a total amount not to exceed $28,476,000.00. The scheduled contract completion date is March 22, 2027.

 

As of June 19, 2026, the attached list of change orders has been approved.

Per the contract documents, forty-three existing structures are to be rehabilitated. The contractor identified field conditions at certain structures, including pipe misalignment and conflicts with existing manhole steps, that differ from or conflict with the conditions detailed on the contract plans. The engineer field verified the contractor’s observations and proposed corrective actions via RFIs and Formal Communication FC-25. The contractor submitted two change orders, CO-33 and CO-34, to address the field conditions.

 

Item 1: As part of the original contract scope, existing ventilation structures are scheduled for rehabilitation under Item 5B. The original scope of work includes removal and replacement of ductile iron pipes, fittings, valves, and stem guides within the existing ventilation structures. Through RFI-97, the contractor notified the engineer of a conflict in Manhole 1 between the proposed valve actuator/stem extension assembly and the existing manhole steps, which are to remain in place. Through RFI-102, the contractor notified the engineer of a similar conflict in Manhole 12 between the proposed valve stem extension/support bracket and the existing manhole steps. Because the existing ventilation structures have similar configurations, similar conflicts may be encountered at other ventilation structures and will be confirmed as the work progresses.

 

The contractor submitted CO-33 for the removal and replacement of manhole steps, where directed by the engineer, to avoid conflicts with the proposed valve stem extensions and support brackets in the existing ventilation structures. The work will be tracked and paid on a time-and-material basis in accordance with Articles 7 and 8 of the General Conditions in an extra amount not to exceed $75,000.00, with a credit in the amount of $0.00, for a net extra amount not to exceed $75,000.00.

 

Item 2: The contractor submitted cost proposal CO-26 to address pipe misalignment in thirty-one (31) manholes, which was approved by the Board of Commissioners on April 16, 2026. The approved scope of CO-26 was limited to the installation of an additional restrained coupling in each identified manhole. During the course of construction, additional field conditions were identified at two of these manholes, Manholes 13 and 40, as well as at four additional manholes, Manholes 8, 21, 34 and 37.

 

To facilitate proper alignment and connection of the rehabilitated piping system, the contractor submitted cost proposal CO-34 to furnish and install additional fittings, spool pieces, couplers, flange adapters, and bends at Manholes 8, 13, 21, 34, 37 and 40. The work included in CO-34 is separate from and in addition to the work previously approved under CO-26. Applicable credits have been applied to the change order. The contractor submitted a cost proposal (CO-34) for this work for an extra in the amount of $93,184.28, and a credit in the amount of $2,970.00, for a net extra in the amount of $90,214.28.

 

The engineer reviewed the cost proposals CO-33 and CO-34, found them to be reasonable, and stated the Engineering Department would recommend their approval.

 

These change orders are in compliance with the Illinois Criminal Code since the changes are due to circumstances not reasonably foreseeable at the time the contract was signed and are in the best interest of the District.

 

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to increase Contract 07-027-3SR in an amount not to exceed $165,214.28 (0.51% of the current contract value), from an amount of $32,539,940.03, to an amount not to exceed $32,705,154.31.

 

Funds are available in Account 401-50000-645750.
